Welcome to betterclass! Before using our website and services, please carefully read these Terms and Conditions. By accessing or using betterclass, you acknowledge that you have read, understood, and agreed to comply with these Terms and Conditions, including our Privacy Policy.

1. Acceptance of Terms

By using betterclass or purchasing any of our services, you agree to be bound by these Terms and Conditions, as well as any additional terms, policies, or guidelines that may apply to specific services or features. These terms govern your access to and use of our website and services, and you acknowledge that you have read, understood, and accepted them in full.

If you do not agree with any part of these terms, you must refrain from using our website, services, or any related content. Your continued use of betterclass constitutes your acceptance of these Terms and Conditions and any updates or modifications that may be made in the future.

We may modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. We may notify you of significant changes via email or through a prominent notice on our website; however, it is your responsibility to review these Terms and Conditions periodically for updates. Your continued use of betterclass after any modifications constitutes your acceptance of the updated terms. If material changes are made that negatively affect your rights, we will provide reasonable notice (typically 30 days) before the changes become effective. Your only remedy for disagreeing with updated terms is to cease using the service.

2. User Accounts

To access certain parts of our services, you may be required to create an account. By creating and using an account, you agree to the following terms:

Accurate and up-to-date information: You agree to provide accurate, complete, and up-to-date information during the registration process. You are responsible for ensuring that your account information remains current, and you agree to update it as needed.

Age verification: You must be 18 or older to use betterclass. Accounts found to be created by minors may be suspended. We reserve the right to request age verification documentation if we have reason to believe you do not meet this requirement.

Confidentiality and security: You are solely responsible for maintaining the confidentiality of your account, username, and password. You agree to take all necessary precautions to prevent unauthorized access to your account.

Account sharing and multiple access: You must not share your account or password with others. Sharing your login credentials, allowing others to access your account, or permitting access from multiple IP addresses is strictly prohibited.

Manual usage reviews: We reserve the right to manually inspect accounts that show abnormal usage patterns, including download history, login IPs, and access frequency. If we determine unusual activity, we may require you to provide additional verification before restoring full access.

Inactive accounts: Accounts inactive for more than 12 months may be deleted without notice.

Non-transferability: Your account and subscription are for your personal use only and may not be transferred, reassigned, or shared.

Ownership clarification: You do not own your betterclass account. It is licensed to you for personal use and may be revoked at our discretion.

Communications: By signing up, you agree to receive transactional emails such as subscription updates, security notices, payment receipts, and marketing campaigns. You may unsubscribe from promotional messages, but not service-related ones.

3. Account Suspension and Deletion

We reserve the right to suspend or delete your account for violating any part of these Terms. This includes, but is not limited to:

  • Providing false registration information
  • Sharing login credentials
  • Engaging in abuse, fraud, or misuse of our platform
  • Uploading materials to public repositories or AI systems
  • Excessive downloading or use patterns
  • Chargebacks or payment disputes
  • Violations of intellectual property rights

Suspended accounts may lose all access and content without refund. You may also request deletion of your account at any time. Deleted accounts do not qualify for any refund for the remaining subscription period.

4. Pricing

Subscription plans are:

  • Monthly: $10 USD

  • Quarterly: $25 USD

  • Yearly: $99 USD

All prices are in USD. If you pay in another currency, your payment provider will convert it at their prevailing exchange rate. We are not responsible for currency conversion fees or fluctuations. Applicable taxes may be added to your subscription cost depending on your location. We may update pricing at any time, with changes applying after your current term ends. Users will be notified of material price increases via email.

5. Payment Methods

We accept Visa, MasterCard, Apple Pay, Google Pay, and other methods listed on our checkout page. Payments are processed securely by third-party payment providers. We are not responsible for fraud, data breaches, or security failures of third-party payment processors, though we implement industry-standard security measures. Manual payments (e.g., Wise or PayPal) are available on request for countries not supported by our default payment gateway. Processing times for manual payments may take 1-5 business days.

6. Subscriptions

By subscribing to our services, you agree to the following terms:

Automatic renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it prior to the renewal date. The renewal will occur on the same date each month/quarter/year. Billing dates are based on UTC time. You acknowledge and agree that we will charge your payment method for the applicable subscription fee for each renewal period, unless you take action to cancel your subscription before the next billing cycle begins.

Authorization to charge: You authorize betterclass to charge your designated payment method for the subscription fees associated with your plan. This includes any applicable taxes or additional fees as outlined during the subscription process. You are responsible for ensuring that your payment method is valid and up to date. If there is an issue with your payment, we may suspend or terminate your access to the services until payment is successfully processed.

7. Cancellations & Payment Retries

You may cancel your subscription renewal at any time through your account settings. Upon cancellation, your subscription will remain active until the end of the current billing cycle, after which access to our services will be discontinued. Our support team does not handle cancellation requests since it is something you can do easily on your end.

Please note that all payments are non-refundable, and no refunds will be issued for any fees already paid, regardless of the cancellation date. Cancellation only applies to future billing cycles and does not entitle you to a prorated refund.

Immediate termination of access may occur under the following circumstances:

  • Fraud or Payment Issues: If there is suspected fraud, chargebacks, or failed payments, access may be revoked immediately.
  • Violation of Terms of Service: If your account is found to be in breach of our policies, including misuse or abuse of our services, access may be terminated without prior notice.
  • Digital Product Access: If your subscription includes access to downloadable content or licensed digital materials, cancellation may result in the immediate loss of access to those resources.

If a subscription payment fails, betterclass will automatically attempt to reprocess the payment depending on the payment method selected at checkout (determined by your country):

Primary payment method: The system will make up to five (5) retry attempts, following a structured schedule. If payment is still unsuccessful after these attempts, your subscription status will be set to On-hold and will require manual resolution before access is restored.

Secondary payment method: The system will make up to two (2) retry attempts within the current month. If both attempts fail, the system will continue retrying two times in each subsequent month until the payment succeeds or the subscription is canceled.

It is your responsibility to ensure that your payment details are accurate and that sufficient funds are available. Access to services may be suspended during the retry process until payment is successfully completed.

8. Refund Policy

We take pride in providing high-quality, downloadable lesson materials for educators. As our products are digital goods, they cannot be “returned” once downloaded. Therefore, all sales are final, and we do not offer refunds under any circumstances except in cases of proven technical defects that prevent access to the product.

Situations where refunds are not provided:

  • You changed your mind after purchasing
  • The materials did not meet your expectations
  • You purchased the wrong item by mistake
  • You lack the necessary software or skills to use the materials
  • You no longer need the lesson plan after downloading it
  • Your purchase was made more than 24 hours ago
  • You found a similar or free version elsewhere after purchase
  • You expected features or materials that were not advertised
  • You purchased the subscription for someone else
  • You misunderstood the product’s suitability for your teaching style
  • Your payment was made using someone else’s account without their consent
  • You experienced minor technical issues that do not prevent access
  • You failed to cancel before the renewal date
  • You claim unauthorized access but do not provide verifiable proof
  • You forgot to cancel a free trial or subscription before renewal
  • You purchased a discounted or promotional item marked “no refunds”
  • You downloaded the materials and then requested a refund
  • You changed jobs, stopped teaching, or no longer have use for materials
  • You misunderstood the refund policy or assumed exceptions would be made

Exceptional Circumstances

A refund may be considered only if:

  • The lesson plan is not as described: If the content is significantly different from the product description or preview provided on our website.
  • The file is corrupted or cannot be accessed: If you are unable to open or use the PDF file due to a technical issue on our end, and our support team is unable to resolve the issue.
  • Duplicate purchase: If you accidentally purchased the same item twice within the same account, we can review your request for a refund.

Requesting a Refund

If you believe your purchase qualifies for a refund, please contact our support team within 24 hours of your purchase with the following details:

  • Order number
  • Description of the issue
  • Screenshots or other relevant evidence.

We will review your request and respond within a reasonable timeframe. If a refund is granted, it will be processed back to the original payment method used.

Refund and Chargeback Abuse

We reserve the right to deny service and terminate access for users who repeatedly request refunds or initiate chargebacks without valid reasons. Accounts with a pattern of refund abuse or disputed transactions may be blacklisted and banned from future purchases. We take refund manipulation seriously, as it affects our ability to provide affordable content to genuine educators.

9. Intellectual Property

All content available through betterclass, including but not limited to lesson plans, instructional materials, website features, text, images, graphics, and audio content, is the exclusive property of betterclass and is protected by copyright, trademark, and other applicable intellectual property laws.

By purchasing a subscription, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the materials for personal and educational purposes only. This license permits you to use the lesson plans within your own teaching environment, whether in-person or online, provided that access is restricted to your enrolled students in a closed, private setting.

You do not own:

  • Any lesson plan, file, or content on betterclass
  • Your account page or any part of the site layout
  • The structure, design, or delivery of our platform
  • Any modified, saved, or downloaded versions of our materials
  • Any intellectual property associated with betterclass

You are strictly prohibited from:

  • Redistributing, reselling, or sharing betterclass materials in any form, whether for free or for profit, including uploading to teacher marketplaces, content repositories, or file-sharing platforms
  • Modifying, adapting, translating, or altering the content for distribution beyond your personal teaching use
  • Uploading or sharing the materials on public websites, forums, social media platforms, or any third-party repositories
  • Using the content for commercial purposes beyond its intended classroom use
  • Removing or altering any copyright notices, proprietary markings, or attribution
  • Creating derivative works for distribution or resale

Use in AI or Machine Learning Systems

Our materials may not be used to train, fine-tune, evaluate, or otherwise develop AI models, large language models (LLMs), machine learning systems, or other automated systems. This includes using any part of our content for dataset creation, model testing, prompt engineering, or uploading to public or private AI platforms, including but not limited to ChatGPT, Claude, Gemini, or similar systems. Violations of this policy may result in legal action and immediate termination of access without refund.

Any unauthorized use, reproduction, or distribution of our materials may result in the termination of your subscription without refund and may also lead to legal action, including claims for damages.

10. Content Usage for Schools and Institutions

Schools, language centers, and other educational institutions are welcome to use betterclass materials as part of their curriculum; however, each teacher who accesses the content must have their own individual subscription. A single subscription is intended for personal use by one educator and cannot be shared among multiple instructors.

To maintain compliance with our terms, institutions must adhere to the following guidelines:

  • One subscription per teacher – Each teacher utilizing betterclass lesson plans and resources must hold an active, separate subscription. Sharing a single account across multiple educators is strictly prohibited.
  • No shared login credentials – Schools and institutions may not share login details among staff members. Each teacher must use their own personal account to access materials.
  • Penalty for violations – If betterclass detects that a personal subscription is being shared among multiple educators within a school or team, the institution or responsible party will be liable for a penalty fee of $3,000 USD per violation, in addition to immediate account suspension. This compensation reflects the unauthorized multi-user access and lost revenue from unpurchased subscriptions.
  • Bulk licensing options – Institutions that require multiple licenses for their faculty can contact betterclass for customized bulk licensing packages, which may include discounts or administrative access for easier subscription management.
  • Restricted distribution – While teachers may use betterclass materials in their classrooms, the content cannot be stored on shared institutional servers, intranet systems, or cloud platforms accessible by multiple users without explicit permission from betterclass.

Failure to comply with these terms may result in the suspension or termination of access without refund. Institutions seeking multi-teacher access should reach out to betterclass to discuss appropriate licensing solutions.

Institutions and individuals may not download or store betterclass materials in bulk for use in shared drives, LMS platforms, or offline repositories. The content is intended for immediate teaching use only. Mass archiving or long-term digital storage of materials is prohibited without written permission.

11. Third-Party Links and Resources

Our website may include links to third-party websites, services, or resources for informational purposes or convenience. These external sites are not operated, controlled, or endorsed by betterclass, and we do not assume responsibility for their content, accuracy, availability, or any potential risks associated with their use.

By clicking on third-party links, you acknowledge and agree that:

  • betterclass has no control over external sites – We do not monitor, verify, or maintain third-party content and are not liable for any changes, inaccuracies, or issues that may arise.
  • Your interactions are at your own risk – Any engagement with third-party websites, including purchases, data sharing, or account creation, is solely your responsibility. We recommend reviewing the terms, policies, and security measures of these external platforms before proceeding.
  • betterclass is not liable for third-party actions – We are not responsible for any damages, losses, or issues resulting from your interactions with third-party services, including but not limited to security breaches, misleading information, or service disruptions.

12. Privacy Policy

By using our services, you agree to comply with our Privacy Policy, which outlines how we collect, use, store, and protect your personal information. We are committed to safeguarding your privacy and ensuring that your data is handled with the utmost care and security. Our Privacy Policy provides detailed information on the types of data we collect, the purposes for which we use it, and the measures we take to protect it.

We take your privacy seriously and are dedicated to ensuring that all personal information is processed in accordance with applicable laws and regulations. If you have any questions or concerns about how we handle your data, please refer to our Privacy Policy or contact us directly.

13. Prohibited Activities

To maintain the integrity and security of our platform, users must refrain from any actions that could disrupt, damage, or compromise betterclass, its services, or other users. The following activities are strictly prohibited:

  • Engaging in unlawful or fraudulent activities, including identity fraud, financial scams, or misleading claims.
  • Attempting to gain unauthorized access to restricted areas of the website, user accounts, or internal systems.
  • Copying, modifying, reproducing, or redistributing betterclass content, including lesson plans and materials, without explicit permission.
  • Uploading viruses, malware, spyware, or any harmful code that could interfere with platform functionality or compromise user data.
  • Engaging in excessive automated requests, spamming, or other activities that degrade system performance or availability.
  • Using betterclass content to train, develop, or test any form of AI or machine learning system.

  • Archiving large portions of content offline or attempting to build a private content library or external repository.

Mass Downloads and System Abuse
Our lesson materials represent significant time and effort to create. While we aim to offer accessible pricing, unlimited mass downloads for a low monthly fee are not feasible. Allowing unrestricted bulk downloads would risk the long-term viability of betterclass and the quality of service we provide.

To protect the quality of service for all users, excessive or automated downloading of materials in a short period of time is strictly prohibited. This includes downloading a large number of files within a few minutes or using scripts, bots, or other tools to bypass normal usage. Such activity is considered a violation of our Terms and may result in immediate suspension or permanent cancellation of your subscription without refund.

We expect users to download content responsibly, focusing on materials they need for their teaching. If you need access to many files, we recommend spacing downloads over time or contacting us to discuss higher-tier plans or institutional licenses.

We monitor download activity to detect abuse and enforce limits. Users found violating this policy may receive warnings, have their download privileges restricted, or have their accounts suspended or canceled.

Violations of these terms may result in immediate termination of access, legal action, or other necessary measures to protect the platform and its users. If you suspect misuse or security concerns, please report them to our support team immediately.

Manual Usage Reviews
To protect our platform, we reserve the right to manually audit user behavior, including login history, IP usage, and download patterns. If your activity appears suspicious or inconsistent with normal teaching use, we may contact you for clarification, restrict your account during review, or permanently terminate access without refund.

14. Disclaimer of Warranties

We provide our services and materials on an “as is” and “as available” basis. This means that, while we strive to offer the best experience possible, we do not make any express or implied warranties or guarantees regarding the functionality, availability, accuracy, or reliability of our services, content, or materials.

To the fullest extent permitted by law, we do not guarantee that:

  • Our services will be uninterrupted, error-free, or free from viruses or other harmful components
  • The materials will be suitable for a particular teaching style, proficiency level, or learning objective
  • The content will remain available or unchanged indefinitely
  • Users will not experience technical glitches, delays, or access issues
  • Our platform will be compatible with all devices, browsers, or operating systems
  • Third-party integrations or linked resources will function correctly

Educational Content Disclaimer

betterclass provides lesson plans and educational materials as resources for English language teachers. These materials are not a substitute for professional instruction, formal education programs, or qualified teaching. Teachers are responsible for adapting materials to the needs of their students, complying with local educational standards, and ensuring student safety and learning outcomes. betterclass does not guarantee that use of our materials will result in student learning gains or achievement of language proficiency goals.

Furthermore, we disclaim any responsibility for any loss, damage, or inconvenience caused by your reliance on the services or materials, or for any actions taken based on such content. Any content, advice, or recommendations provided through our services is intended solely for informational purposes and should not be construed as professional, legal, or educational advice.

We do not accept responsibility for any issues, including but not limited to service interruptions, data loss, or any technical problems that may arise from using our platform, whether due to external factors or internal system failures. By using our services, you acknowledge and agree that you do so at your own risk and that we are not liable for any consequences, directly or indirectly, that may result from the use of our services or materials.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, betterclass SHALL NOT BE HELD LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE USE OF OUR SERVICES. This includes, but is not limited to, damages resulting from data loss, service interruptions, system errors, unauthorized access to accounts, loss of revenue, business interruption, loss of profits, or any other issues related to the use of our platform.

We are not responsible for any loss of data, disruption to your activities, or any financial, emotional, or reputational harm that may occur as a result of using our services. This includes situations where there are delays, errors, or inaccuracies in the information provided, as well as circumstances where unauthorized third parties gain access to your account or personal data despite our security measures.

By using our services, you agree that betterclass, its affiliates, employees, or partners shall not be held liable for any damages, losses, or costs incurred, whether foreseeable or unforeseeable, even if we have been advised of the possibility of such damages.

Liability Cap

In no event shall our total liability to you exceed the amount you have paid to betterclass in the 12 months preceding the claim. This cap applies to all claims, regardless of legal theory (contract, tort, strict liability, or otherwise). Some jurisdictions do not allow the limitation or exclusion of liability, so this provision may not apply to you.

16. Indemnification

By using betterclass, you agree to indemnify, defend, and hold harmless betterclass, its employees, affiliates, directors, officers, and partners from any and all claims, losses, damages, liabilities, costs, and expenses (including but not limited to legal fees and court costs) arising out of or in connection with:

  • Your violation of these Terms and Conditions
  • Your violation of any applicable laws, regulations, or policies
  • Your use of the betterclass platform in violation of these terms
  • Your misuse or unauthorized use of our services
  • Actions taken by you that cause harm, damage, or legal consequences to betterclass or any third parties
  • Claims by third parties related to your use of our services or content
  • Your infringement of intellectual property rights
  • Your violation of a third party’s privacy or personal rights

You agree to take full responsibility for any consequences resulting from your breach of these Terms and Conditions and will cover all costs and damages incurred by betterclass in relation to such breaches. betterclass reserves the right to assume the exclusive defense and control of any matter subject to indemnification, at your expense, and you agree to cooperate fully with betterclass in the defense of any such claims.

17. Support and Service Availability

betterclass provides customer support on a best-effort basis. We aim to respond to support inquiries within 48 business hours, but we do not guarantee response times or resolution times. Support availability may vary, and we are not responsible for delays caused by system outages, high ticket volumes, or other circumstances beyond our reasonable control.

We do not guarantee continuous, uninterrupted service. Maintenance windows, updates, or unforeseen technical issues may temporarily affect platform availability. We will attempt to provide advance notice of scheduled maintenance when possible, but emergency repairs may occur without warning.

18. Force Majeure

betterclass shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, wars, acts of terrorism, civil unrest, strikes, epidemics or pandemics, government actions, Internet infrastructure failures, or major system outages caused by third parties.

In the event of a force majeure event, we will make reasonable efforts to resume service as soon as practicable. We will not be liable for any damages, losses, or claims arising from our inability to provide services during such events. If a force majeure event prevents us from providing services for more than 30 days, you may cancel your subscription and receive a prorated refund for the remaining balance of your subscription period.

19. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which betterclass is established, without regard to its conflict of law principles. All disputes, claims, or controversies arising from or relating to these Terms and Conditions or your use of betterclass shall be resolved exclusively in the courts of that jurisdiction, and you hereby consent to the personal jurisdiction and venue of such courts.

Arbitration and Mediation

Before initiating legal action, you and betterclass agree to attempt to resolve disputes through good faith negotiation and, if necessary, mediation. If direct negotiation does not resolve the dispute within 30 days, either party may initiate arbitration or legal proceedings. In the event of arbitration, each party shall bear its own costs, with arbitration fees split equally unless otherwise determined by the arbitrator.

20. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect. We will make reasonable efforts to replace any severed provision with one that is enforceable and reflects our original intent.

21. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any other policies or guidelines posted on our website, constitute the entire agreement between you and betterclass regarding your use of our services. These terms supersede all prior negotiations, representations, and agreements, whether written or oral, relating to the subject matter herein. No course of dealing, course of performance, or trade usage shall modify these terms.

If you have agreed to specific additional terms with betterclass through a separate contract (such as an institutional license), those terms shall apply in addition to or, where they conflict, in place of these general Terms and Conditions.

22. Termination of Services

We reserve the right, at our sole discretion, to terminate, suspend, or restrict your access to our services at any time, with or without prior notice, if you violate these Terms and Conditions or engage in any activities deemed prohibited by betterclass. This includes, but is not limited to, actions that may harm the integrity of our platform, disrupt other users’ experiences, or violate applicable laws, regulations, or our policies.

Chargebacks and Payment Disputes

If you initiate a chargeback or payment dispute without first contacting our support team to resolve billing issues, your account and all access to betterclass will be terminated immediately. You may be permanently barred from future use of our services and listed in fraud prevention databases.

betterclass may take such actions if we determine that your use of our services is unlawful, harmful, abusive, or otherwise inappropriate. We also reserve the right to block or remove any content you post or share that violates our guidelines, without notice or liability.

In the event of termination or restriction of access, you understand that you will no longer be able to use the services, and any data or content associated with your account may be deleted or made inaccessible without recovery. You agree that we will not be liable for any loss or damage resulting from the suspension or termination of your access.

betterclass may, at its discretion, choose not to enforce this provision in any particular case, but any such delay or failure does not waive our right to enforce this provision in the future.
